3.5 Sharing account access with third parties is done at your own risk. Hostveda Cloud will not be liable for any consequences resulting from such access, including misuse or service disruption.

4. Acceptable Use Policy

4.1 Customers agree to use Hostveda Cloud services only for lawful purposes and in a manner that does not violate any applicable laws, regulations, or the rights of others. Use of services must not interfere with or disrupt the integrity or performance of our network or systems.

4.2 Prohibited activities include, but are not limited to, engaging in illegal operations, distributing malware or harmful software, conducting phishing or fraudulent schemes, sending unsolicited bulk emails or spam, attempting unauthorized access to systems, or hosting content that promotes illegal or abusive behavior.

4.3 Customers must not use our services in a way that causes excessive resource consumption or negatively impacts other users. Activities such as abusive scripts, crypto mining, or any process that threatens server stability may result in immediate action to protect system performance.

4.4 We reserve the right to investigate any suspected violations and to suspend or terminate services without notice if activities are deemed harmful, illegal, or in breach of these Terms. Cooperation with law enforcement authorities may occur where required by law.

4.5 Customers are responsible for ensuring that all content hosted through our services complies with applicable intellectual property laws and does not infringe upon the rights of third parties.

5. Payments & Billing

5.1 All services provided by Hostveda Cloud are billed in advance according to the billing cycle selected during purchase. Customers are responsible for ensuring that payments are made on time to avoid service interruptions.

5.2 Failure to pay invoices by the due date may result in service suspension, restriction, or termination. Services may be restored upon full payment of outstanding balances, subject to applicable policies.

5.3 Prices and service fees are subject to change at our discretion. Any changes will be communicated through official channels or reflected in updated invoices or service notices.

5.4 Payments made through supported payment methods, including online payment gateways or digital currencies, are processed according to the respective provider’s policies. Cryptocurrency transactions are considered final once confirmed on the network and are generally non-reversible.

5.5 Customers are responsible for any applicable taxes, transaction fees, or charges associated with their payment method. Disputes or chargebacks may result in service suspension pending investigation.

5.6 It is the customer’s responsibility to ensure that billing contact information remains accurate and that payment reminders or notifications are monitored to prevent accidental service disruption.

 

6. Refund Policy Reference

8. Data & Backups

8.1 Customers are solely responsible for maintaining independent backups of their data, websites, emails, and any other content hosted on our servers. While we may provide backup mechanisms as a convenience, they are not guaranteed and should not be relied upon as the sole backup solution.

8.2 Hostveda Cloud does not guarantee the availability, accuracy, or recoverability of backups in all circumstances, including but not limited to hardware failure, software issues, security incidents, or accidental deletion.

8.3 We shall not be held responsible for any data loss or damage resulting from customer actions, third-party activities, or unforeseen technical events.

8.4 Customers are encouraged to regularly verify the integrity of their backups and ensure that critical data is stored securely.

9. Limitation of Liability

9.1 To the fullest extent permitted by applicable law, Hostveda Cloud shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to the use or inability to use our services, including but not limited to loss of data, loss of revenue, business interruption, or loss of profits.

9.2 Customers acknowledge that the use of hosting and related services involves inherent risks, and services are provided on an “as available” basis without warranties of any kind, whether expressed or implied.

9.3 Hostveda Cloud shall not be responsible for any damages resulting from unauthorized access to customer accounts, customer negligence, third-party actions, or events beyond our reasonable control, including network failures, hardware malfunctions, or force majeure events.

9.4 In no event shall the total liability of Hostveda Cloud exceed the amount paid by the customer for the affected service during the applicable billing period.

9.5 Customers agree that they use our services at their own risk and assume full responsibility for any consequences arising from their use.

10. Service Availability / Uptime Disclaimer

10.1 Hostveda Cloud strives to maintain reliable and consistent service availability; however, uninterrupted or error-free operation cannot be guaranteed at all times.

10.2 Scheduled maintenance, system upgrades, security updates, or unforeseen technical issues may occasionally result in temporary interruptions or reduced performance. Such activities are necessary to ensure the stability and security of our infrastructure.

10.3 Hostveda Cloud shall not be held liable for downtime or service interruptions caused by factors beyond our control, including network outages, upstream provider issues, hardware failures, cyber incidents, or natural events.

10.4 While we take reasonable measures to minimize disruptions, customers acknowledge that occasional downtime is inherent in internet-based services.

10.5 Customers are responsible for implementing appropriate redundancy and contingency plans where continuous availability is critical to their operations.

11. Domain Services

11.1 Domain registration, renewal, and related services are subject to the rules and policies of the respective domain registries and registrars. Customers agree to comply with all applicable domain regulations and requirements.

11.2 Customers are responsible for providing accurate and complete domain registration information and for keeping such information updated. Failure to maintain accurate information may result in suspension or loss of the domain.

11.3 Hostveda Cloud is not responsible for domain expiration, loss, or suspension resulting from non-payment, failure to renew, incorrect contact details, or customer oversight.

11.4 Domain registrations and renewals are generally non-refundable once processed, due to registry policies and third-party costs involved.

11.5 Customers acknowledge that domain transfers, availability, and registration approvals are subject to registry procedures and may be declined or delayed for reasons beyond our control.

 

12. Changes to Terms

12.1 Hostveda Cloud reserves the right to modify, update, or revise these Terms of Service at any time to reflect changes in our services, legal requirements, or operational practices.
